Terms of Service

These terms govern use of ProbeScribe. By creating an account or using the service, the clinic and its users agree to these terms.

Role of the clinic

The clinic is the Health Information Custodian (or equivalent under applicable provincial or federal law) for the exams it records in ProbeScribe. The clinic is responsible for its own regulatory compliance, including obtaining any patient consent required by law, publishing its own information practices, and meeting its breach notification obligations.

Role of ProbeScribe

ProbeScribe provides a structured-reporting tool. It acts as the clinic's agent or electronic service provider. It does not interpret images, does not make diagnostic decisions, and does not replace the radiologist's clinical judgement.

Permitted use

  • Recording ultrasound findings for a real clinical exam.
  • Generating a radiologist draft for review by a qualified radiologist.
  • Administering your clinic's users, protocols, and audit records.

Prohibited use

  • Using ProbeScribe as a primary diagnostic device.
  • Relying on generated drafts without radiologist review.
  • Attempting to extract or re-identify data from other clinics.
  • Uploading direct patient identifiers that are not required for operation.

No medical advice; no warranty of clinical accuracy

ProbeScribe is provided on an "as is" basis. It is a documentation aid. Generated drafts may contain errors or omissions. The radiologist retains full clinical responsibility for every report. To the maximum extent permitted by law, ProbeScribe disclaims any warranty that its output is clinically accurate, complete, or suitable for any particular patient.

Limitation of liability

To the maximum extent permitted by law, ProbeScribe and its operators are not liable for indirect, incidental, or consequential damages arising from use of the service, including clinical decisions made on the basis of generated drafts.

Termination and data return

Either party may terminate the service. On termination, exam data is returned to the clinic or deleted at the clinic's direction within a reasonable period.
